ORDER OF COURT

IN THE COURT OF COMMON PLEAS OF ALLEGHENY COUNTY,
PENNSYLVANIA

      AND NOW, to-wit, this 19th day of September, 2000, following consideration of the Petition for Preliminary Injunction of Daniel S. Shrager, M.D., it is hereby ORDERED, ADJUDJED and DECREED that Magellan Behavioral Health, Highmark Blue Cross and Blue Shield and Greenspring Health Services are hereby enjoined as follows:

  1. Dr. Shrager is to be immediately reinstated as a fully credentialed psychiatric care provider in the Highmark system for both new and existing patients;

  2. defendant Highmark or any subsidiaries are to identify any and all parties whom they have informed that Dr. Shrager is no longer a participating Behavior Health Specialist, to contact each of those persons in writing and inform them of the fact that he has been reinstated as a participating Behavior Health Specialist. Dr. Shrager shall assist Highmark in identifying those patients;

  3. all parties shall proceed immediately to begin the internal administrative review process to insure that Dr. Shrager receives all rights to which he is entitled to under Pennsylvania law and in accordance with the contracts between and among the parties;

  4. bond is set at $10,000.00;

  5. no further pleadings shall be filed at this number without leave of this Court.

    Any appeal of this Order is excluded from the prohibition of paragraph "e".
